Terms of Service

These terms govern your use of ShopPhoto AI, including uploads, AI-generated previews, purchases, downloads, and support.

1. Agreement and eligibility

By accessing shopphotoai.com, uploading an image, or purchasing files, you agree to these Terms, our Privacy Policy, Acceptable Use Policy, and Refund Policy. You must be at least 18 years old and able to enter a binding contract. If you use the service for a business, you confirm that you can bind that business.

2. The service

ShopPhoto AI transforms one real product photo into multiple AI-generated product scenes. You can review watermarked previews before deciding whether to make a one-time purchase for the corresponding high-resolution files. No subscription or user account is required for the current service.

3. Your uploads

You retain ownership of your source images. You confirm that:

  • you own or have permission to upload and process the image;
  • the image and product do not violate law, privacy, publicity, or intellectual-property rights;
  • you will not upload sensitive personal information or prohibited content; and
  • you will follow our Acceptable Use Policy and relevant marketplace rules.

You grant us and our service providers a limited, worldwide licence to host, copy, process, and transmit your content only as needed to provide, secure, and support the service. This licence ends when the content is deleted, except for legally required records and limited backups.

4. Previews and purchased output

Watermarked previews are for evaluation only and may not be removed, resold, or presented as paid output. After successful payment, we grant you a non-exclusive, worldwide right to use the unlocked output for lawful personal and commercial purposes, subject to these Terms and any rights in your source image, product, trademarks, or third-party content.

AI outputs may not be unique. Other users may receive visually similar backgrounds, compositions, or styles. We do not guarantee that output is registrable, exclusive, or free from every possible third-party claim.

5. AI accuracy and your review

AI-generated images can alter colour, shape, labels, text, logos, materials, shadows, or product details. You are responsible for reviewing each image before publication and for ensuring that it accurately represents the product and complies with advertising, consumer-protection, marketplace, and disclosure requirements.

6. Prices, payment, and taxes

Prices, currency, and applicable taxes are shown before payment. Purchases are one-time transactions processed by Creem as merchant of record. Creem may appear on your statement or receipt and handles payment processing, tax collection, refunds, and disputes under its applicable customer terms. We do not store full payment-card details.

7. Immediate digital delivery and withdrawal rights

When you request immediate access to digital files, delivery may begin before the end of any statutory withdrawal period. Where the law requires it, we will ask for your express consent to immediate performance and acknowledgement that you may lose a withdrawal right once digital delivery begins. This does not limit rights that cannot legally be waived, including remedies for faulty or misdescribed digital content.

8. Refunds and disputes

Refund eligibility and the request process are described in our Refund Policy. Contact us before filing a payment dispute so we can investigate delivery, duplication, or technical issues. Nothing in these Terms excludes mandatory consumer rights.

9. Availability and retention

Unpaid images are normally deleted within 24 hours. Purchased files and recovery links are normally available for 7 days. You are responsible for downloading and backing up purchased files before they expire. We may change, suspend, or discontinue features, but will make reasonable efforts not to interfere with completed purchases during their stated delivery window.

10. Prohibited conduct

You may not misuse the service, bypass security or usage limits, interfere with other users, scrape or reverse engineer protected systems, or create unlawful, infringing, deceptive, abusive, or harmful material. The complete restrictions appear in our Acceptable Use Policy.

11. Our intellectual property

The service, software, brand, interface, documentation, and original site content belong to ShopPhoto AI or its licensors. These Terms do not grant permission to copy, resell, frame, or create derivative versions of the service itself.

12. Disclaimers

To the maximum extent permitted by law, the service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability. We do not guarantee sales, marketplace approval, search ranking, or business results from any generated image.

13. Limitation of liability

To the maximum extent permitted by law, ShopPhoto AI will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages. Our aggregate liability relating to the service will not exceed the greater of the amount you paid us for the affected purchase or US$100. These limits do not apply where liability cannot lawfully be limited.

14. Suspension and termination

We may reject content, suspend access, or terminate use when reasonably necessary to address illegality, security threats, fraud, payment disputes, policy violations, or harm to the service or others. Provisions that by their nature should survive termination will remain in effect.

15. Governing rules and changes

Applicable law governs these Terms without removing mandatory rights available to consumers in their country of residence. We may update these Terms as the service or law changes. The revision date above identifies the current version; material changes will receive appropriate notice.
